It has been two weeks because Bill Cosby got his attorneys are already hoping to get him from jail -- and the judge in his case pitched, also.A defense motion filed Friday summarizes his lawyers' requests, including the overturning of the celebrity's certainty and three-to 10-year sentence due to mistakes made in his sex attack trial and case.
"The defendant, William H. Cosby, Jr., moves this Court for a new trial in the pursuit of justice, or for reconsideration and modification of the sentence imposed on September 25, 2018," the motion says, based on Deadline.Cosby's defense team asserts Judge Steven O'Neill should have recused himself against the sentence hearing after the 2017 mistrial and resulting retrial that spring.
"For the reasons detailed in Mr. Cosby's previously-filed motions for recusal (that can be incorporated by reference, without being replicated and put forth at length), and also for all the foregoing reasons, a reasonable observer will question the impartiality of the judge who imposed the September 25, 2018, sentence," the filing states. "Thus, Judge O'Neill must have recused himself from imposing sentence."
